2. About Lostora

Lostora is an online platform that allows users to publish, search, view, and communicate about lost and found jewelry and related items.

Lostora acts only as a technology platform and communication service. Lostora does not take possession of items, does not verify ownership, and does not act as a finder, owner, buyer, seller, broker, courier, insurer, law enforcement authority, public lost and found office, or mediator between users.

3. Eligibility

You may use Lostora only if you are legally permitted to do so under the laws applicable to you.

You must be at least 18 years old or have the permission of a parent or legal guardian to use Lostora. If you use Lostora on behalf of a company, organization, or another person, you confirm that you are authorized to do so.

4. User Accounts

Some features of Lostora require a user account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate, current, and complete information and to keep your account information up to date. You must not share, transfer, sell, or misuse your account.

5. Account Security

You must notify Lostora if you suspect unauthorized access to your account. Lostora is not responsible for losses caused by your failure to keep your login credentials secure.

6. Lost Item Reports

Users may create reports for lost jewelry or related items. You are solely responsible for the accuracy, legality, and completeness of any information you provide.

You should not publish all unique identifying details of an item if such details may be needed later to verify ownership.

7. Found Item Reports

Users may create reports for found jewelry or related items. If you find an item, you are responsible for complying with all applicable laws, including any local obligations to report or hand in found property to public authorities, lost and found offices, police, or other competent institutions.

Lostora does not replace official reporting obligations and does not provide legal advice regarding found property.

8. Ownership Claims and Verification

Lostora does not verify ownership of lost or found items. Users are solely responsible for verifying ownership claims before returning, shipping, handing over, or accepting any item.

Lostora is not responsible for disputes regarding ownership, authenticity, value, condition, possession, or return of any item.

9. No Guarantee of Recovery or Return

Lostora does not guarantee that any lost item will be found, identified, returned, or recovered. Lostora also does not guarantee that a found item belongs to a specific person.

Visibility on Lostora, map placement, notifications, matching features, paid features, or contact with other users do not guarantee any result.

10. User Content

Users are solely responsible for all content they create, upload, publish, send, or otherwise provide through Lostora, including photos, descriptions, item details, messages, profile information, contact information, and location data.

You must not upload or publish content that:

• is false, misleading, fraudulent, or deceptive
• violates laws or regulations
• infringes copyrights, trademarks, privacy rights, or other rights
• contains offensive, abusive, hateful, threatening, or harassing material
• contains malware, spam, or harmful code
• exposes sensitive personal data of others without permission
• creates a safety risk for other users or the platform

11. License to User Content

You retain ownership of the content you upload. By uploading or submitting content to Lostora, you grant Lostora a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to store, host, reproduce, display, publish, process, transmit, translate, adapt, and use such content as necessary to operate, improve, secure, and promote the platform.

This license continues as long as necessary for operation of the platform, legal compliance, backups, dispute resolution, and legitimate business purposes.

12. Photos and Image Rights

You may upload photos only if you have the necessary rights and permissions. You must not upload copyrighted images, images of third parties, private documents, personal data, or other protected material unless you are legally allowed to do so.

13. Location Information

Lostora may allow users to provide approximate locations for lost or found items. You are responsible for choosing the level of detail you publish.

You should avoid publishing private addresses or sensitive locations unless necessary and legally permitted.

14. User Messages and Communication

Lostora may provide messaging or contact features between users. Users are solely responsible for their communications and for any arrangements made with other users.

The following are prohibited:

• harassment, threats, or abusive behavior
• fraud, scams, or impersonation
• spam or unsolicited advertising
• illegal offers or requests
• attempts to obtain passwords, payments, or sensitive data unlawfully

15. Meetings, Returns, Shipping, and Handover

Any meeting, return, shipment, handover, reward, reimbursement, or other arrangement is solely between the users involved. Lostora is not a party to such arrangements.

Users are responsible for choosing safe methods of communication and return. Lostora recommends using safe public locations and involving official authorities where appropriate.

16. Rewards and Finder Fees

Users may voluntarily offer rewards or reimbursements. Lostora does not guarantee payment, collection, enforcement, or fulfillment of any reward, finder fee, compensation, reimbursement, or other promise made by a user.

17. Prohibited Activities

You must not:

• submit false, fake, or misleading reports
• claim ownership of an item that is not yours
• impersonate another person or organization
• create abusive or duplicate accounts
• scrape, crawl, or automatically collect platform data without permission
• reverse engineer or interfere with the platform
• attempt unauthorized access to systems or accounts
• use Lostora for illegal activities
• misuse maps, messages, uploads, or contact features
• damage, overload, or disrupt the platform

18. Fraud Prevention and Safety

Lostora may take technical, organizational, and manual measures to detect abuse, fraud, spam, scams, fake reports, suspicious behavior, or other misuse.

Lostora may restrict visibility, remove content, limit features, suspend accounts, or report suspected unlawful activity where appropriate.

19. Content Moderation

Lostora may review, remove, edit, restrict, block, or disable access to content at its discretion if the content violates these Terms, applicable law, third-party rights, platform safety, or may create risk for Lostora or other users.

Lostora is not obligated to monitor all content and does not guarantee that unlawful or inaccurate content will be detected immediately.

20. Copyright and Intellectual Property Complaints

If you believe that content on Lostora infringes your copyright, trademark, privacy rights, or other rights, please contact:

Lostora may remove allegedly infringing content while reviewing a complaint.

21. Lostora Intellectual Property

Lostora, including its name, design, software, source code, layout, branding, logos, texts, graphics, database structure, and platform concept, is protected by intellectual property and other laws.

You may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, or exploit Lostora without prior written permission.

22. Paid Features and Premium Services

Lostora may offer paid features, premium listings, subscriptions, promotional placements, visibility boosts, notifications, or other paid services.

Prices, duration, and included features will be shown before purchase. Paid services do not guarantee recovery, return, identification, contact, or any particular result unless expressly stated otherwise.

23. Payments, Taxes, and Billing

Users are responsible for providing accurate billing information. Payment processing may be handled by third-party payment providers.

Unless required otherwise by law, fees for paid features may be non-refundable once the service has started or the feature has been made available.

24. Right of Withdrawal

If you are a consumer in the European Union, you have a statutory right to withdraw from a paid contract within 14 days without giving any reason.

Because our paid listing features are digital services that begin immediately upon payment (your listing becomes visible right away), we ask you to expressly consent to immediate performance at checkout. By confirming your purchase, you acknowledge that Lostora begins performing the service immediately, and you expressly agree that your right of withdrawal ends once the service has been fully performed. If the service has not yet been fully performed, you may still withdraw within 14 days, in which case we will refund a proportionate amount for the service not yet provided.

To exercise your right of withdrawal, contact us at info@lostora.com with a clear statement of your decision to withdraw.

25. Third-Party Services

Lostora may use or link to third-party services, including hosting, database, authentication, storage, maps, email, payment, analytics, and infrastructure providers.

Lostora is not responsible for third-party websites, services, availability, content, policies, or actions.

26. Availability and Changes to the Platform

Lostora may modify, suspend, limit, update, replace, or discontinue any part of the platform at any time. Lostora does not guarantee uninterrupted, secure, error-free, or permanent availability.

27. No Professional or Legal Advice

Lostora does not provide legal, insurance, valuation, ownership, security, or professional advice. Information on the platform is for general platform use only.

28. Disclaimer of Warranties

Lostora is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Lostora makes no warranties regarding accuracy, reliability, availability, security, suitability, effectiveness, or fitness for a particular purpose.

29. Limitation of Liability

To the maximum extent permitted by law, Lostora shall not be liable for:

• lost, stolen, damaged, or unrecovered items
• unsuccessful recovery attempts
• false, inaccurate, or misleading user content
• ownership disputes
• meetings, handovers, returns, shipments, payments, or rewards between users
• unauthorized access or misuse of accounts
• service interruptions, technical errors, or data loss
• indirect, incidental, special, consequential, or punitive damages
• loss of profit, revenue, business, goodwill, or opportunity

30. Mandatory Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law, including liability for intent, gross negligence, injury to life, body, or health, or mandatory statutory liability.

31. Indemnification

You agree to indemnify and hold harmless Lostora, its operator, employees, contractors, service providers, and partners from claims, damages, liabilities, losses, costs, expenses, and legal fees arising from:

• your use of Lostora
• your content
• your messages or communications
• your violation of these Terms
• your violation of laws or third-party rights
• disputes between you and other users

32. Privacy

Use of Lostora is also governed by the Privacy Policy. The Privacy Policy explains how personal data is collected, used, stored, and protected.

33. Changes to These Terms

Lostora may update these Terms from time to time. The updated version will be published on the platform. Continued use of Lostora after an update means that you accept the revised Terms.

34. Governing Law

These Terms shall be governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods.

35. Jurisdiction

Where legally permissible, the place of jurisdiction shall be Erding, Germany. Mandatory consumer protection rules and mandatory places of jurisdiction remain unaffected.

36. Severability

If any provision of these Terms is invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

37. Entire Agreement

These Terms constitute the entire agreement between Lostora and users regarding the use of the platform, unless additional terms apply to specific services.
